GENERAL CONDITIONS GOVERNING THE ONLINE SALE OF INDIVIDUAL ENTRANCE TICKETS

These general conditions of sale (hereafter referred to as the 'General Conditions of Sale') apply to all purchases of tickets to visit the musée du quai Branly - Jacques Chirac made via its website, www.quaibranly.fr.

The website, the source code, text and images featured on the site and all other components thereof are the exclusive property of the musée du quai Branly- Jacques Chirac. All of the content featured on the site is protected by copyright legislation. Subsequently, and in accordance with the provisions of the French Intellectual Property Code, the site is intended for private use only. Any other use of the site is liable to result proceedings being brought before the competent court or tribunal.
 
ARTICLE 1 - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The Customer acknowledges that they have read and understood these General Conditions of Sale prior to placing their order. The placing of an order implies that the Customer accepts the general conditions without exception. This being the case, they declare and acknowledge that they are perfectly familiar with the conditions in question and therefore abstain from invoking any other document.
The musée du quai Branly - Jacques Chirac reserves the right to adapt or modify these General Conditions of Sale at any time. In the event of any modifications being made, the General Conditions of Sale in force on the day on which the order in question is placed shall apply.
 
ARTICLE 2 - IDENTIFICATION OF THE PARTY BEHIND THE OFFERING

ARTICLE 3 - DEFINITIONS
All of the terms that appear below, whether in their singular or plural format, are used with the following meaning:
'TICKET': refers to the entrance ticket enabling the holder to visit the musée du quai Branly - Jacques Chirac, regardless of the method by which it is issued and its format, purchased by the Customer via the Website. TICKET prices can be found on the Website. The applicable price is that in force on the day on which the order is placed.
'Customer': refers to any person purchasing a TICKET via the Website and who has accepted the General Conditions of Sale.
'General Conditions of Sale': refers to the general conditions contained herein, which are designed to set out the conditions governing the purchase and use of TICKETS and include the attached price list.
'Price list': refers to the list outlining the prices of the different types of ticket for the musée du quai Branly - Jacques Chirac, as attached to the General Conditions of Sale.
 
ARTICLE 4 - TICKETS OFFERED FOR SALE
4.1 Services to which TICKETS provide access
TICKETS available to purchase online via quaibranly.tickeasy.com give the holder a right of entry to the musée du quai Branly-Jacques Chirac. These TICKETS are valid for individual visits only (fewer than 10 people).

4.2 Validity period of TICKETS issued
Each TICKET issued is valid only for the date and, where applicable, time stated on the TICKET itself or for a specified period. Each TICKET entitles the holder to enter each of the exhibition spaces at the musée du quai Branly Jacques Chirac twice. Exit from the venue is deemed definitive.
 
ARTICLE 5 - TICKET PRICES AND ORDER AMOUNTS
TICKET prices are stated in euros and are payable in this currency only. Prices are stated, on the TICKET, inclusive of all taxes.
The applicable price is that in force on the day on which the order is placed. The musée du quai Branly - Jacques Chirac reserves the right to change the ticket price at any time.
Various prices apply depending on the type of visit and the age and status of the visitor. Pricing conditions can be found at quaibranly.tickeasy.com when placing your order.
Passes entitling the holder to free admission can only be obtained from the ticket office or automatic ticketing machines at the musée du quai Branly - Jacques Chirac, upon presentation of supporting documentation.
The Customer acknowledges that they are aware of the criteria they must meet in order to benefit from a reduced rate or free admission. In the event that these prices are not available on the Website, the Customer agrees to forego the reduction or to purchase their TICKET from the ticket office on the day of their visit.
Proof that the Customer meets the respective criteria will be requested when the TICKET is inspected.
 
ARTICLE 6 - ORDERING
The Customer shall place their order for one or several TICKETS offered for sale at quaibranly.tickeasy.com.
The procedure for placing an order online consists of the following steps:
6.1 The Customer selects the day, and where applicable the time, they wish to visit the museum and the number of tickets they require at each price, subject to availability. The Customer will be informed in real time, when placing their order, of the availability of the TICKETS they wish to purchase.
6.2 The Customer creates a Customer account by entering their email address and a password. The creation of a Customer account involves the provision of certain mandatory information required to process the order, including the Customer's first name, surname, phone number and email address.
6.3 A summary of the total order will be displayed. After checking their order and confirming that they have read and agree to these General Conditions of Sale, the Customer proceeds to pay for their order online by providing their bank details (numbers, expiry date and security code) via a secure platform.
In the event that payment is refused by the payment centre in question, the order will automatically be cancelled. Payment for the order on the part of the Customer represents definitive acceptance of the order, which cannot be contested.
6.4 TICKETS ordered via this site can be printed (see printing conditions outlined below) either immediately, once the payment has been accepted, or at a later date, via a link sent to the email address provided. The Customer is responsible for ensuring that the details provided when making the booking are correct.
 
ARTICLE 7 - ISSUING OF TICKETS
A printout of the confirmation page or the email confirming the Customer's purchase and sent to them by the musée du quai Branly-Jacques Chirac does not constitute a TICKET. Under no circumstances can this document be used as a TICKET or allow the holder to access the museum.
TICKETS to be printed at home are available in PDF format once the Customer has confirmed their purchase and can be printed by the Customer up until the date of the visit by clicking on the link provided in the email confirming the purchase or via the Customer's personal account, which can be accessed via the Website. In order to be valid, a single copy of the TICKET must be printed on white A4 paper, blank on both sides prior to printing. The Customer must print one barcode (TICKET) for each person.
TICKETS downloaded onto mobile phones (m-tickets) are also accepted.
Each TICKET has its own barcode that enables the holder to enter the musée du quai Branly - Jacques Chirac.
The printing must be of a high quality. Partially printed, soiled, damaged or illegible TICKETS will not be accepted and will be considered invalid. In order to check the print quality, the Customer must ensure that the information printed on the TICKET, along with the barcode, is clearly legible.
The Customer must ensure that they have the necessary software and hardware required to print the TICKETS, including a computer connected to the Internet, a printer and version 8.0 or later of Acrobat Reader, before placing their order. TICKETS may also be presented in PDF format on a smartphone or tablet.
No facilities are available for Customers to print their TICKETS at the museum on the day of their visit. The Customer must therefore have printed their TICKET before they arrive at the entrance point.
In the event that a TICKET is lost, stolen or duplicated, only the first person to present said TICKET will be considered to be the rightful holder of the TICKET and allowed to enter the musée du quai Branly - Jacques Chirac.
Under no circumstances can the musée du quai Branly - Jacques Chirac be held responsible in the event that a TICKET is lost or stolen. A duplicate ticket may be issued at the ticket office upon presentation of ID, login details and date of booking, provided that the TICKET has not already been used.
 
ARTICLE 8 - PAYMENT TERMS
8.1 Methods of payment
Customers may pay for TICKETS in euros and using a credit or debit card only. The following cards are accepted: CARTE BLEUE, VISA, EUROCARD, MASTERCARD and JCB.
8.2 Payment transaction
The Customer assures the musée du quai Branly - Jacques Chirac that they have all authorisations necessary to use the method of payment chosen when placing the order.
After placing the order, the Customer will be redirected to a secure payment server where they will be asked to accept the General Conditions of Sale, in accordance with the conditions outlined above, and pay for the order online using their bank card details, including the card number, expiry date and security code shown on the back of the card.
The value of the order will be debited from the Customer's bank account or charged to their credit card once the transaction has been approved by the payment centre. In the event that payment is refused by the payment centre, the order will automatically be cancelled.
The Customer's bank card will be charged independently of the printing of the TICKETS.
All purchases are final and definitive, and the Customer shall not have the option to cancel or modify their order once the payment has been confirmed.
8.3 Invoice
As soon as the transaction is completed, the Customer will be informed of this on the payment page and will receive an email confirming their purchase if they have provided this information in the payment window.
8.4 Payment security
The museum uses the services of Payzen, which uses a secure online payment system that encrypts the Customer's card number, for all payments for orders of TICKETS for the musée du quai Branly - Jacques Chirac placed at quaibranly.tickeasy.com.
The PayZen secure payment solution uses the TLS protocol (for encrypting all card-related information) and has obtained various seals of approval (PCI DSS certification, CB Cartes Bancaires approval, Visa Merchant agent approval, etc.). This ensures that the Customer's bank details are protected since only the payment approval codes issued by the bank are stored.
The musée du quai Branly - Jacques Chirac ensures that the cryptology methods and services used to secure transactions have been authorised or declared in accordance with the legislation in force.
 
ARTICLE 9 - ORDER CONFIRMATION
9.1 Once the payment centre has confirmed receipt of the payment for the order, the Customer will receive an order confirmation email from the musée du quai Branly - Jacques Chirac's online ticketing site.
9.2 The confirmation email acknowledges that the order has been received and contains the following information:
- the key characteristics of the TICKET(S) sold (location, date and time of the visit)
- the unique transaction number
- the total value of the order
- the electronic link for printing the TICKET(S)
9.3 The 'Your tickets' email also contains the following information:
- your tickets, along with an electronic link for printing the ticket(s)
 
ARTICLE 10 - CONDITIONS GOVERNING THE USE OF TICKETS
All TICKETS are automatically inspected at the entrance to the venue by scanning the barcode printed on the TICKET
Only TICKETS bearing a perfectly legible barcode and text will be accepted. Partially printed, soiled, damaged or illegible TICKETS will be refused.
TICKETS are strictly personal and non-transferable.
The TICKET allows the holder to avoid having to queue at the ticket office and to go straight to the designated entrance, unless otherwise stated.
All TICKETS bearing a reduced entry price must be presented together with proof of eligibility for this reduced rate.
Only the following valid documents will be accepted for these purposes: an ID card, a Carte Famille Nombreuse card, a Pass Education card or a Pass Quai Branly card.
TICKETS are valid only for the visit and period stated on the ticket itself.
TICKETS must be retained until the end of the visit.
The musée du quai Branly - Jacques Chirac reserves the right to refuse entry to the venue in question in the event that a visitor presents a TICKET without fulfilling the conditions outlined above.
Visits to the venue are also subject to the musée du quai Branly - Jacques Chirac's visitor regulations, which can be consulted on the musée du quai Branly - Jacques Chirac's online ticketing service.
 
ARTICLE 11 - CONDITIONS GOVERNING REFUNDS AND EXCHANGES
In accordance with Article L.121-20-4, 2 of the French Consumer Code, the Customer shall not benefit from the 7-day withdrawal period referred to in Article L.121-20 of the same code.
No TICKET purchased can be returned or refunded, even in the event of it being lost or stolen or forgotten at the time of the visit.
In light of the security restrictions by which it is bound, the musée du quai Branly - Jacques Chirac reserves the right to close or to change its opening hours.
In the event that it is no longer able to provide the service stated on the TICKET, the musée du quai Branly - Jacques Chirac shall contact the Customer by email as soon as possible to inform the latter that this is the case and offer the following options:
            - either, where possible, to use the same TICKET to access the service in question at a later date and/or time;
            - or to obtain a refund for the TICKET concerned, outlining the applicable terms and conditions.
 
ARTICLE 12 - LIABILITY
12.1. For services
In accordance with Article L. 121-20-3 of the French Consumer Code, under no circumstances can the musée du quai Branly - Jacques Chirac be held responsible for any failure or poor execution of the services to which the TICKET entitles the holder that is attributable to the customer, to any unforeseen and insurmountable circumstances involving a third party, or to an instance of force majeure, as outlined in Article 13 of these General Conditions of Sale.
12.2 For the issuing of TICKETS
With the exception of any malfunctions of the quaibranly.tickeasy.com website for which it is responsible, the musée du quai Branly - Jacques Chirac shall not be held responsible for any malfunctions that might occur during the ordering, processing, downloading or printing of the TICKET that are attributable to the customer, to any unforeseen and insurmountable circumstances involving a third-party that is not involved in the provision of the service or to an instance of force majeure, as outlined in Article 13 of these General Conditions of Sale.
12.3 Provisions regarding use of the website
The musée du quai Branly - Jacques Chirac is unable to guarantee that the Website will entirely meet the Customer's expectations or that no error will occur when using the Website.
The Website is available 24 hours a day, 7 days a week, subject to closure for maintenance and repair work or in the event of an instance of force majeure or any event or incident beyond the control of the musée du quai Branly - Jacques Chirac.
The musée du quai Branly - Jacques Chirac shall not be held responsible in the event of any loss or damage suffered by the Customer or any third party as a result of any problem with accessing the Website, the Internet, any means of telecommunication or, more generally, as a result of any instance of force majeure, as outlined in Article 13, when visiting the Website or placing an order.
The musée du quai Branly - Jacques Chirac shall not be held responsible for any damages resulting from the use of the Internet, such as the loss of any data, intrusion, viruses or disruption to the service.
The musée du quai Branly Jacques Chirac shall not be held responsible for any non-compliant use of the Website and/or the online ticketing service by the Customer or any other third party.
In the event of any attempt to hold the musée du quai Branly - Jacques Chirac responsible for any breach on the part of the Customer of any of the stipulations of the General Conditions of Sale, the musée du quai Branly - Jacques Chirac may implead the Customer.
The Customer shall be held solely responsible for their choice to order the TICKET and for the terms governing the issuing of the TICKET. As a result, the musée du quai Branly - Jacques Chirac shall not be held responsible for any malfunction relating to any problem of compatibility between the TICKET and the Customer's IT environment.
 
ARTICLE 13 - FORCE MAJEURE
The musée du quai Branly - Jacques Chirac shall not be held responsible for the failed execution of any service that may result from any incident of force majeure that is recognised as such by the case law of the French courts and tribunals.
 
ARTICLE 14 - PROOF, RETENTION AND ARCHIVING
Any electronic registers stored, under reasonable security conditions, within the musée du quai Branly - Jacques Chirac's electronic systems or those of any other service provider enlisted by the former, shall be considered proof of the sales contract, the date on which it is taken out, and the orders and payments to which it relates.
Orders and receipts will be archived in a reliable and durable format that guarantees a reliable copy, in accordance with the relevant Article of the French Civil Code.
 
ARTICLE 15 - PROTECTION OF PERSONAL DATA
The Customer shall be asked to provide certain information of a personal nature (customer's first name and surname, email address and mobile phone number) when placing their order.
This information is required in order to process and track said order and shall also be used should the need arise to postpone or cancel the provision of the service to which the TICKET entitles the holder.
Any personal data gathered shall be processed by the musée du quai Branly - Jacques Chirac in accordance with the legal provisions regarding the protection of personal data stemming from Act No. 78-17 of 6th January 1978, the French Data Protection Act. The Customer is informed that this authorised processing of information has been declared to the CNIL.
The Customer has the right to access, modify, rectify or delete any personal data relating to them at any time and may exercise this right by sending an email to the Customer Service department at cnil@quaibranly.fr or a letter to the following address:

The Customer may consent to receiving newsletters by SMS or email when entering their personal data by ticking the corresponding boxes.
 
ARTICLE 16 - APPLICABLE LAW - LITIGATION
The ticketing service sales to which these General Conditions of Sale apply are subject to French law.
In the event of a complaint, an amicable solution shall be sought prior to any legal action being taken before the competent Parisian court or tribunal.
The Customer has a period of 60 days from the date on which they purchase the TICKET to submit a complaint.
